Tips for Protecting Your Assets During Your Divorce

A common point of contention in an Indiana divorce is the question of how the marital assets will be divided. Reason with Your Ex

When you don’t already have an existing pre- or postnuptial agreement with your soon-to-be ex, and you want to protect your valuable assets, the best option available is to reason with your ex. 

In Indiana, the division of marital property, debts, and assets is equitable, not equal which means your spouse will be entitled to their fair share of the marital assets. If there are certain items you’d like to retain, coming to an agreement with your spouse may be the best way to ensure that these items remain yours.

Attend Mediation

Unfortunately, if it were that easy to reason with your spouse, you probably wouldn’t be getting a divorce. But that doesn’t mean you can’t still work with them to come to a divorce settlement that meets the needs of both spouses. 

Attending mediation is a great way to accomplish this task, even if you are not normally able to get along with your ex. The mediator can listen to both parties concerns and then make helpful suggestions that could resolve these matters before having to go to court. 

Of course, in mediation, both parties will need to prepare for negotiation and there needs to be some give and take in any mediation sessions for a resolution to be successful. But when some valuables are more important to you than others, you can use these items as leverage to protect that assets that matter most.

Do Not Attempt to Hide Your Assets

One of the worst things you can do during a divorce is to hide your assets. For one, your spouse more than likely already knows that you have these assets, and if they don’t, it will surely be revealed during discovery. 

Second, the fact that you made an attempt to hide your assets makes you look dishonest, which isn’t going to fare well for you if you are unsuccessful in mediation and your case goes before the judge. Honesty is the best policy, and your attorney will do everything possible to ensure that the assets that are rightfully yours remain so once your divorce is finalized.
