Preparing for Tampa Traffic Court

Posted By Hersem Law in Criminal & DUI

If you’ve been ticketed in Tampa, you might be a little nervous at the idea of fighting your ticket in traffic court. You might be worried about saying or doing the wrong thing.

That’s why preparing for traffic court is so important. Your lawyer can help you build your defense and work to get your ticket reduced or dismissed.

We’re here to help you prepare for traffic court in Tampa and fight hard for you. For more specifics on how we’ll do that, see below.

The Process

The process begins with an arraignment date—if you request one. If an arraignment is necessary, such as for thirty-over speeding or an accident involving serious injury or death, the arraignment will be set, and you’ll be unable to pay your ticket.

The purpose of the arraignment is to advise you of the charges against you and then have you enter a plea of guilty, no contest, or not guilty.  Your attorney from Hersem law will file a written plea of not guilty on your behalf, which satisfies the purpose of arraignment and waives your presence at the court date.

A hearing date will then be set. At the hearing, the police officer and any witnesses will be subpoenaed to attend. This is the opportunity for us to meet with the officer and witnesses, examine any documents they have, and hear their version of events. We’ll try to match their version of events with yours or discredit them based on what you have given us.

Your Tampa traffic ticket attorney from Hersem Law will then go in front of the Judge for a full contested hearing or with a negotiated resolution that we’re asking the Judge to approve (such as a reduced charge or dismissal).

Paying Your Ticket: Almost Never a Good Idea

It has to be said: Paying your ticket is almost never a good idea. That’s because paying the ticket is essentially the same thing as pleading guilty.  You’ll face a hefty fine, points on your license, and increased insurance costs.

That’s why it’s important to contest your ticket. With the right legal assistance, you may be able to beat the ticket altogether.

As an added bonus, teaming up with an experienced traffic ticket lawyer from Hersem Law may mean that you never actually have to go to Tampa traffic court. We may be able to appear on your behalf and fight for you.
