California's Motorcycle Helmet Laws

Most motorcycle riders are aware of the importance of wearing a helmet, especially in the event of a motorcycle crash. It’s important that you understand the laws surrounding helmets, as well.

In California, all motorcyclists are required to wear helmets that meet federal safety standards. In fact, California is what’s known as a universal helmet law state, meaning everyone on a motorcycle—regardless of age—must wear a helmet.


Helmets for Drivers and Passengers on Motorcycles

In California, both drivers and passengers must wear helmets when on a motorcycle, motorized bicycle, or motor-driven cycle. A helmeted passenger may not ride with an un-helmeted driver. Likewise, a helmeted driver can be ticketed if he or she is transporting an unhelmeted passenger. 

Additionally, the helmet must be worn on the head. The chin straps must be fastened, and the fit of the helmet must limit excessive lateral or vertical movement.


Penalties for Helmetless Motorcycle Driving or Riding

The California Highway Patrol will penalize riding or driving a motorcycle without a helmet with a fine. However, there is some debate regarding the appropriate penalty. Some feel that helmetless riding or driving is an equipment offense and that helmetless riders or drivers should be able to correct the equipment failure to avoid a fine.


Choosing the Right Helmet

Federal safety standards for motorcycle helmets are set by the US Department of Transportation. Minimum safety standards include:

  • An inner liner made of polystyrene foam that is at least one inch thick

  • A sturdy, riveted chin strap attached to the shell of the helmet

  • A weight of at least three pounds

  • A design that allows no protrusions of more than two-tenths of an inch from the shell

  • A helmet that meets minimum standards may be affixed with a sticker attesting to this.
